GENERAL BUSINESS CONDITIONS

General business terms regulate the legal relations between the association of legal persons of
KLASTER LIPTOV – tourism association (hereinafter referred to as„Klaster LIPTOV”) and the owner of
the regional discount card LIPTOV Region CARD (hereinafter referred to as „card owner“).
1.1 Product definition - regional discount card “LIPTOV Region Card“
Regional discount card LIPTOV Region Card (hereinafter referred to as “LIPTOV Card”) is a card with
a bar code and unique number, which allows its holder to benefit from a discount of 10% up to 50%
on the services offered by all card partners - trip spots, attractions and facilities. The card obtained
for a lump-sum fee allows its holder to claim a discount on entrances to different attractions and
trip spots localised in the Liptov region. Providers of services of individual trip spots and attractions
listed in the LIPTOV Card offer are contract partners of the LIPTOV Card (hereinafter referred to
as“contractor”). The LIPTOV Card is issued in and distributed through authorized sales points of the
Klaster association.
1.2 The card owner
1.2.1. The card owner is a person who purchased the valid LIPTOV Card through an authorized
point of sale or directly at the cash desk of the trip spot or attraction. The card is not transferable
and it is issued in the name of its owner. Providing the LIPTOV Card to third parties is prohibited.
1.2.2. In the case of selling the card through internet or individual contract point-of-sale, the card
can be replaced by a replacement “voucher”in a printed form. The voucher will be replaced by the
LIPTOV Card at the selected points of sale in the LIPTOV region, announced to the“voucher”holder
in advance.
1.3 Information booklet “Guide to the Liptov region
The booklet “Guide to the Liptov region”(hereinafter referred to as “Guide”) is distributed together
with the LIPTOV Card and issued by Klaster LIPTOV in the beginning of winter and summer tourist
season.
1.4 Selling price of the LIPTOV Card
LIPTOV Card is available at a selling price specified in the actual valid price list. The actual selling
price of the LIPTOV Card is listed at the points of sale, in the printed guide or on the website
www.liptovcard.sk.
1.5 Concluding the contract
Contractual relationship ( “LIPTOV Card - contract”) between Klaster LIPTOV and the card owner
comes into existence by paying the purchase price for the LIPTOV Card or printing out the
“voucher” at the point of sale. First name, surname and date of birth of the card owner together
with the bar code, unique number and the card validity period will be printed on the backside of
the LIPTOV card.
1.6 Points of sale
Points of sale are selected trip spots and attractions offered by LIPTOV Card, contractual lodging
facilities in the LIPTOV region, Ticketportal company and its contract partners in Slovakia, Czech
republic, Hungary and Poland, information centres, travel agencies and other agencies in the
Liptov region and the Intersport store in Liptovský Mikuláš.
1.7 Card owner rights
1.7.1. The owner of the card is authorized to use all discounted services provided by the contract
partners in the scope and quality specified in the Guide during the whole validity period of the
LIPTOV card. Klaster LIPTOV does not run the services offered by individual trip spots, attractions,
or lodging and gastronomic facilities. The description of offered services, opening hours and
operating capacity quoted in the guide is valid.
1.7.2. Every trip spot, attraction and lodging or gastronomic facility is eligible to inspect and verify
the identity of the LIPTOV Card holder. The card owner is entitled to use the offered services after
proving his/her identity by showing his/her valid ID card with a photograph. Any use of the LIPTOV
Card is recorded by an electronic reading device, manual entry of data into an electronic database
or in the pre-printed form.
1.7.3. Owner of the card automatically becomes the client of a LIPTOV Card contract partner by
using its services. All claims of the card owner related to the provision of services provided by a
given contractor, particularly a claim for compensation for damages caused by the contractor and
claims arising from the lack of guarantee provided, are claimed directly from the contractor. Klaster
LIPTOV is not liable for potential damages caused to the card holder by using services of the given
contractor. Klaster LIPTOV is not obliged to perform checks on its contract partners related to the
safety and quality of services offered. Therefore, Klaster LIPTOV does not assume any responsibility
for the services offered by individual contractors of the LIPTOV Card and has no control over them.
The legal relationship between the contractor of the LIPTOV Card and the card owner is governed
by the valid business terms and conditions of the given contractual partner.
1.8 Card owner duties
Every card owner is required to keep his/her card carefully. The act of stealing the card by third
parties without any great effort is considered a negligent use. Negligence is also considered, when
the card owner provides the card or the data stored on it to third parties. The LIPTOV Card can be
used only for its intended purposes. Any other use of the card is prohibited. Misuse of the card
entitles Klaster LIPTOV to premature termination of the contract according to section 1.10.1.9 Changes in the scope of services and prices by partners
1.9.1. Limitations applied to services and use of the services provided by individual contract
partners can be caused by unfavourable weather conditions, circumstances related to season,
technical conditions or maintenance work implementation. In case of serious reasons leading to
limitations of services offered, Klaster LIPTOV is entitled to terminate the cooperation with the
contractor during the LIPTOV Card validity period. In case of limitation or total interruption of
services on the bases of the above mentioned facts, the card holder doesn’t have the right to claim
any compensation or price reduction. Limitation or total interruption of services will be announced
by Klaster LIPTOV as soon as possible on the website www.liptovcard.sk.
1.9.2. The change in prices of services provided by individual partners is reserved. Klaster LIPTOV
is not responsible for the pricing policy of its contractors and does not guarantee the prices of
their services. The amount of discounts granted by contract partners of the LIPTOV Card remains
68 unchanged during the whole LIPTOV Card validity period.
1.9.3. The owner of the card is required to notify the association Klaster LITPOV of a possible
change of personal data in writing. In the event that the card owner changed his/her address
during the card validity period, but didn’t announce this fact, written notifications sent by Klaster
LIPTOV to the last delivering address given by the card holder will come into force.
1.10 Contract duration
1.10.1. LIPTOV Card-contract is valid during the LIPTOV Card validity period, which is printed on the
backside of LIPTOV Card („contract duration“). Card is valid during actual tourist season and during
next season (season SUMMER – 01.05.-14.11., season WINTER – 15.11.-30.04.). Upon expiration of
the contract duration, the LIPTOV Card automatically loses its validity without being terminated.
The card owner is entitled to use the LIPTOV Card as long as the contract relationship lasts and
the card is valid.
1.10.2. The owner of the card and the Klaster LIPTOV association are entitled to terminate the
LIPTOV Card-contract on the basis of compelling reasons prematurely and with immediate effect.
The reason for the termination of the contract relationship may be misuse of the card by the card
owner or providing the card to third parties. In such case, Klaster LIPTOV is eligible to block the
card without offering compensation. The card owner is obliged to hand over the LIPTOV Card
without delay.
1.10.3. Transfer of bonus services provided by contract partners into the next season will
automatically be possible after completion of the current season.
1.11 Loss/ theft
In case of loss or theft of the card, it is necessary to report this fact to Klaster LIPTOV as soon as
possible. Klaster LIPTOV will block this card immediately and the card owner will be issued a new
LIPTOV card at the actual price.
1.12 Data Protection
Klaster LIPTOV records and processes all personal data of the card owner gained on the basis of the
contract relationship regulating terms of using the LIPTOV Card. These are mainly: first name,
surname, date of birth, city and country of residence, e-mail address as well as signature of card
owner („data“). These data can be used by Klaster LIPTOV for marketing purposes. The data are
further evaluated to improve the LIPTOV Card offer. Klaster LIPTOV is committed to protecting
security of the data against theft and misuse by unauthorized persons by using a security system.
Klaster LIPTOV is committed not to providing or releasing the data to third parties, except for its
members. Providing data to third parties is allowed only with written permission from the card
owner.
1.13 Place of fulfilment and legal proceedings
Legal disputes are handled in accordance with a Slovak legal system. A place appointed to hold
legal proceedings (for LIPTOV Card-contract) is the competent District Court of Liptovský Mikuláš.
